1 – Preamble

 

These General Terms of Use (hereafter referred to as “GTU”) are designed to determine the guidelines for provision and use of the content and services of the web site dravet-syndrome.com (hereafter referred to as the “Website”) between the Website publisher – the company BIOCODEX SAS (hereafter referred to as the “Publisher”) and the internet user (hereafter referred to as the “User”).

 

Access to the Website and its content, as well as the use of the services offered by the Website, implies that the User accepts these GTU without exception. Since the GTU can be modified at any time and without prior notice, the User is invited to consult them regularly.

3 – Purpose of the Website and access to services

 

The Website was designed to present and educate about Dravet Syndrome: causes, treatment management, diagnostic and course of the disease. This website is accessible and searchable by healthcare providers and also general public.  

The Website is accessible anywhere and to any User with an internet connection. All the expenses involved in accessing the Website

(computer hardware, software, internet connection, etc.) are the responsibility of the User.

The Website enables the User to access the following services:

  • general information on Dravet Syndrome
  • news articles links around Dravet Syndrome
  • downloading communication documents
  • a collection of family patients’ testimonies
  • Videos by healthcare professionals and family of patients
  • a contact form

 

The Publisher uses all the tools at its disposal to ensure high-quality access to the Website and to its services. However, this is an obligation of means and not of result: the User thus agrees not to claim any compensation from the Publisher and their suppliers, in the event that the Website is not available at the time when the User wishes to access it.

 

Access to the Website and its services can, at any time and without prior notice, be interrupted, suspended or changed, for maintenance purposes or for any other reason.

 

The Publisher shall not be liable for damages resulting from interference, interruptions, computer viruses, malfunctions or disconnections of the terminal that could temporarily prevent the User’s access or navigation.

 

Although the Publisher has taken the greatest care in developing the Site, it may nevertheless contain inaccuracies. The User is invited to inform the Publisher of any suggestions for optimization.

4 – Responsibilities

 

In accordance with the legislation in force, medicine for human use marketed by Biocodex are declared to the European Medicine Agency (EMA).

Any information provided on the Website is a help for healthcare providers and family of patients around Dravet syndrome. The website is searchable by general public and should replace in any case the medical prescription and information.

The User acknowledges and agrees not to rely on the information it contains to make decisions regarding his health or possible medical treatment without the advice of a health professional.

The Publisher endeavors to provide quality, verified information. However, information sources cannot be completely guaranteed.

Any “outbound” links present on the Website enable the User to access information and other complementary resources available on the internet, or to share information on social networks. The Publisher has no means of controlling the content of these completely independent third-party sites and, as such, cannot be held responsible for the consequences of accessing these third-party sites and their content.

 

5 – Intellectual Property

 

The Website is intellectual work protected by intellectual property law. The Website along with all the items comprising it (such as logos, texts, photographs, images, PDF files and videos, etc.) are the exclusive property of the Publisher. The relevant domain name has been registered and is protected.

Duplication or reproduction in part or in its entirety of the Website or of any of its constituent components is authorised solely for private use. Any duplication or reproduction in part or in its entirety of the Website or of one of its constituent components in any medium and in any manner whatsoever for other purposes and in particular for business ends without formal authorisation from the Publisher and/or the copyright holder is prohibited and shall constitute counterfeiting liable to criminal prosecution.

The same applies to databases featuring in the Website, which are protected by the provisions stipulated in French law dated 1 July 1998 concerning the transposition in the French Intellectual Property Code of European Directive dated 11 March 1996 concerning the legal protection of databases.

Brands and logos featuring in the Website are registered brands (semi-figurative and otherwise). Furthermore, the images featuring in the Website are protected by copyright. Any reproduction in part or in its entirety of said images, brands or logos from this Internet site’s components is not authorised without prior written consent from the Publisher, as defined by article L 713-2 of the French Intellectual Property Code.

6 – Data protection  

 

The Publisher undertakes to comply with the regulatory provisions applicable to the protection of personal data, in particular Regulation (EU) 2016/679 of 27 April 2016 (General Data Protection Regulation).

The User may freely browse the Website without explicitly providing any personal information. Nevertheless, he may be required to provide data concerning him, for example by using the contact form on the Website. In addition, the Site uses “cookies”, which may send data about the User to third parties.

The use of the Website implies, in fact, that the User has read and understood these documents and that he/she has undertaken to consult them regularly.  

 

7 – Applicable law and competent jurisdiction  

 

The GTU are governed by French law. Any conflict or divergence of interpretation will be subject to the jurisdiction of the French courts.
